What the New Overtime Rule Means for Workers

One of the basic principles of the American workplace is that a hard day’s work deserves a fair day’s pay. Simply put, every worker’s time has value. A cornerstone of that promise is the  Fair Labor Standards Act ’s (FLSA) requirement that when most workers work more than 40 hours in a week, they get paid more. The  Department of Labor ’s new overtime regulation is restoring and extending this promise for millions more lower-paid salaried workers in the U.S.

Overtime protections have been a critical part of the FLSA since 1938 and were established to protect workers from exploitation and to benefit workers, their families and our communities. Strong overtime protections help build America’s middle class and ensure that workers are not overworked and underpaid.

Some workers are specifically exempt from the FLSA’s minimum wage and overtime protections, including bona fide executive, administrative or professional employees. This exemption, typically referred to as the “EAP” exemption, applies when: 

1. An employee is paid a salary,  

2. The salary is not less than a minimum salary threshold amount, and 

3. The employee primarily performs executive, administrative or professional duties.

While the department increased the minimum salary required for the EAP exemption from overtime pay every 5 to 9 years between 1938 and 1975, long periods between increases to the salary requirement after 1975 have caused an erosion of the real value of the salary threshold, lessening its effectiveness in helping to identify exempt EAP employees.

The department’s new overtime rule was developed based on almost 30 listening sessions across the country and the final rule was issued after reviewing over 33,000 written comments. We heard from a wide variety of members of the public who shared valuable insights to help us develop this Administration’s overtime rule, including from workers who told us: “I would love the opportunity to...be compensated for time worked beyond 40 hours, or alternately be given a raise,” and “I make around $40,000 a year and most week[s] work well over 40 hours (likely in the 45-50 range). This rule change would benefit me greatly and ensure that my time is paid for!” and “Please, I would love to be paid for the extra hours I work!”

The department’s final rule, which will go into effect on July 1, 2024, will increase the standard salary level that helps define and delimit which salaried workers are entitled to overtime pay protections under the FLSA. 

Starting July 1, most salaried workers who earn less than $844 per week will become eligible for overtime pay under the final rule. And on Jan. 1, 2025, most salaried workers who make less than $1,128 per week will become eligible for overtime pay. As these changes occur, job duties will continue to determine overtime exemption status for most salaried employees.

Who will become eligible for overtime pay under the final rule? Currently most salaried workers earning less than $684/week. Starting July 1, 2024, most salaried workers earning less than $844/week. Starting Jan. 1, 2025, most salaried workers earning less than $1,128/week. Starting July 1, 2027, the eligibility thresholds will be updated every three years, based on current wage data. The rule will also increase the total annual compensation requirement for highly compensated employees (who are not entitled to overtime pay under the FLSA if certain requirements are met) from $107,432 per year to $132,964 per year on July 1, 2024, and then set it equal to $151,164 per year on Jan. 1, 2025.

Starting July 1, 2027, these earnings thresholds will be updated every three years so they keep pace with changes in worker salaries, ensuring that employers can adapt more easily because they’ll know when salary updates will happen and how they’ll be calculated.

The final rule will restore and extend the right to overtime pay to many salaried workers, including workers who historically were entitled to overtime pay under the FLSA because of their lower pay or the type of work they performed.

Ellen DeGeneres says she got thrown out of Hollywood for being mean and toxic -- something she's making light of now in a new stand-up show ... which is coming to Netflix.

The comedian did a live show in L.A. this week, which some reporters had attended -- and she ended up addressing her leaving her famed talk show ... which came to an end in 2022 on the heels of claims from former staffers that the workplace was a nightmare.

Ellen says, "What else can I tell you? Oh yeah, I got kicked out of show business. There’s no mean people in show business."

She adds, "The hate went on for a long time and I would try to avoid looking at the news. The ‘be kind’ girl wasn’t kind. That was the headline. I became this one-dimensional character who gave stuff away and danced up steps ... Would a mean person dance up steps? Had I ended my show by saying, 'Go f*** yourself,' people would’ve been pleasantly surprised."

Ellen also made this crack at one point, saying this was actually the second time she'd been kicked out of showbiz -- referring to the backlash she got in the '90s when she came out -- and added there'd be a third time eventually because "I’m mean, old, and gay."

While she was making fun of the whole ordeal, she got serious at various moments in the set too ... saying the aftermath took a toll on her ego and self-esteem, noting people in Hollywood either love your or hate you, and that the hate often outweighs the love.

She also said this ... "Honestly, I’m making jokes about what happened to me but it was devastating, really. I just hated the way the show ended. I love that show so much and I just hated that the last time people would see me is that way."

Ellen also said the scandal weighed heavily on her wife, Portia de Rossi , and while she was down in the dumps for a long time ... she's grateful to be back onstage anew.

This stand-up of Ellen's is eventually gonna be filmed and released on Netflix in the Fall.

Why is May the 4th considered 'Star Wars' Day?

As most fans know, the fourth day in May became Star Wars Day because of the franchise's iconic phrase, "May the force be with you," which is used by Jedi masters (a specially trained group of leaders and peace-keepers). Sounding similar, the date has become a pun —“May the 4th be with you.”

Is 'May the Fourth' an official holiday?

It's not an actual holiday, unless you live in California.

California's legislature voted in 2019 to officially turn May 4 into "Star Wars Day" after Disneyland opened up Galaxy's Edge in its theme parks.

Where did the phrase 'May the Fourth be with You' start?

If you assumed George Lucas or the marketing team for the franchise came up with the clever date, you'd be wrong. Extremely wrong.

According to Reader's Digest , credit for the pun goes to England’s conservative party after Margaret Thatcher won the election to become the first female prime minister of the United Kingdom, on May 4, 1979. The party, referred to as Tories, took out a newspaper ad that stated, “May the Fourth be with you, Maggie. Congratulations."

Where can I celebrate Star Wars Day in Florida? See events around the state

If you want to geek out with fellow Star Wars fans, Florida has no shortages of places to celebrate this May 4.

Obviously, the top spot to commemorate the movies is Disney World's Galaxy's Edge in Hollywood Studios. The land  transports you to the village of Black Spire Outpost on Batuu—"a remote trading planet that acts as one of the last stops before Wild Space," according to its website .

O.K., since you asked, here's what this ubiquitous, long-used, uniquely Detroit colloquial greeting means.

1) Whatupdoe! — all one word; 2) What up doe , written in three words, also is a common, acceptable use. While often followed with an exclamation point, such punctuation is not always necessary, it just depends on context and how it is used by the subject.

Usage: Similar to the Hawaiian "Aloha," "Whatupdoe!" can mean hello or goodbye. "Doe" is a contraction of the word "though" and does not represent an actual person or a female hoofed ruminant ungulate of the Cervidae family (a female deer).

Alternate meanings: What are you doing? What do you want to do (casually/collegially, or in response to another's use of fighting words) i.e: "I'll whoop yo' a--!" Response — "Whatupdoe?! " Note the change in punctuation, with the addition of a question mark followed by the exclamation point for emphasis. This iteration is typically used with the physical gesture of hands raised or outstretched, signaling it's about to go down/the proverbial poop is about to hit the fan.

Ellen DeGeneres’ new stand-up routine includes a bit about getting booted from Hollywood for being “mean” after her 2020 toxic workplace scandal.

The former “Ellen DeGeneres Show” host, who performed at Largo at the Coronet Theater in West Hollywood Wednesday, complained to viewers that she was “kicked out of show businesses” not once but twice.

“There here’s no mean people in show business. The ‘be kind’ girl wasn’t kind,” DeGeneres, 66, said on stage during her new tour, “Ellen’s Last Stand…Up Tour.” ( via Rolling Stone ).

The “Finding Dory” voice actor reminded viewers that she also got the boot from TV when she came out as gay, thus ending her eponymous sitcom “Ellen” in the late ’90s.

“Eventually they’re going to kick me out for a third time because I’m mean, old, and gay,” she quipped.

DeGeneres experienced her second fall from grace in 2020 when she was accused of leading a toxic workplace , which resulted in the firing of three of her top producers .

Employees came forward and accused DeGeneres of leading the set with intimidation, racism and fear. A producer on an Australian morning show who had been on the set even claimed the comedian demanded no one make eye contact with her.

“I’m giving stuff away…and I danced, then I was mean and they didn’t like me again,” she said during her performance.

“It’s been such a toll on my ego and my self-esteem. There’s such extremes in this business, people either love you and idolize you or they hate you, and those people somehow are louder.”

Warner Bros. canceled the celebrity-filled talk show in 2022 following the controversy.

“This was a whole different thing,” she replied to a fan at the end of the set when she launched into an informal conversation with attendees. “This was like, ‘What is going on?’ It was so hurtful. I couldn’t gain perspective.

“I couldn’t do anything to make myself understand that it wasn’t personal,” she continued. “I just thought, ‘Well this is not the way I wanted to end my career, but this is the way it’s ending.’”

Jokes aside, the “Saving the Gorillas” narrator admitted the scandal was “devastating.”

“I just hated the way the show ended,” she shared. “I love that show so much and I just hated that the last time people would see me is that way.”

DeGeneres and her wife, Portia de Rossi, admitted during the event that they both lay low in the aftermath because it was hard on both of them, but now they’re ready to get back to living.
